TERMS AND CONDITIONS
Before completing registration with First Careers on the Smithells®NZ website, you must read and accept our Terms and Conditions (as set out below) together with our Privacy Policy, Disclaimer and Copyright Statement.
- These Terms and Conditions are the foundation of the agreement between you as the user, and First Careers (NZ) Ltd, as the owner of this web site.
- The Smithells®NZ website is located at smithellsnz.co.nz and accessible through other URLs such as firstcareers.co.nz, firstcareers.com, smithellscareers.co.nz and smithellscareers.com.
- Any use of the words "we" or "us" or "our" or "First Careers" in these Terms and Conditions refers to First Careers (NZ) Ltd. Your use of the Smithells®NZ website and the information on the website and linked to and from the website, is dependent on your acceptance of these Terms and Conditions.
- Before completing registration with First Careers on the Smithells®NZ website, you are recommended to read and required to accept our Terms and Conditions, Privacy Policy, Disclaimer and Copyright Statement (all on bottom bar on Home Page).
- Every time you use the Smithells®NZ website, you may provide personal and/or vocational information about yourself. Please read our Privacy Policy to be clear on your rights in respect of your information.
- You are responsible for any and all use of the Smithells®NZ website using your preferred name, email address and password, whether or not you use or someone else makes use of your preferred name, email address and password. We recommend you do not use an easily guessable password.
- You agree to keep your preferred name, email address and password secure and confidential, and safe from unauthorized use or theft by others. If you have reason to think that your preferred name, email address and password has been misused or stolen, you must let us know straight away by email (click on the Contact menu button on the Home Page).
- Payment for access online to the Smithells® Full or Update Questionnaires, or for other services and goods that may be offered by First Careers on the Smithells®NZ website, is made through a secure payment system, and an integrated Card Security Code (CSC) system.
- All payments are made in New Zealand dollars. For clients outside of New Zealand, the final payment amount showing on your credit card statement may be subject to currency fluctuations and any associated exchange fees, and will be based on the rate used by Visa or MasterCard on the processing date.
- The payment and CSC systems involve Paymark (part of Merchant Services at the ANZ Bank), Pay Station as the Certified Solution Provider (CSP) who provides the internet payment gateway, and Macrotech Ltd, our web host company, who created the online payment, invoice and receipt system.
- When you (or your sponsor) go the Payment page on the Smithells®NZ website to pay online, you will see three things that confirm the secure nature of our payment system. In the web address box at the top of your screen, the first five letters will now be https (the 's' stands for secure). You will also see a locked padlock symbol, and a shield with the word 'Certified' on it.
- As you work through the Questionnaires, you will see throughout your time(s) online, the letters https in the web address box at the top of your screen. This indicates that no one else can see or access your answers.
- Once you complete registration and your payment is confirmed, which gives you secure access to the online Smithells® Full or Update Questionnaires, no refund will be approved.
- From the date of payment on your invoice, you have two months to login and complete the Questionnaires, before your access to them runs out.
- You can login and complete all Questionnaires in one session, OR complete one or more Questionnaires, logout, login again when time suits, and complete more Questionnaires.
- You cannot transfer your preferred name, payment and/or login to another person.
- Once you complete the online Smithells® Full or Update Questionnaires, the emailed Career Information Summary or Client Update Summary you receive is your property, for personal use for career planning purposes.
- After completion of the Questionnaires, you have one week (five working days) to login again and request a free replacement copy of your emailed Summary.
- Where, before or after completing the Smithells® Full or Update Questionnaires online, you wish to request a face-to-face appointment with a Smithells® Professional, please contact that person through the ‘CONTACT’ button on the home page of this website.
- Whether before, during or after completion of the Smithells® Full or Update Questionnaires online,once you have booked an appointment, it is your responsibility to forward to the Smithells® Professional concerned, the Career Information Summary you received from Smithells®NZ as an attachment to an email, directly after you completed the Smithells® Full or Update Questionnaires.
- BY making or confirming an appointment with a Smithells® Professional, and by mailing or forwarding your Career Information Summary to him/her, you are consenting to the access and transfer of your personal and vocational information to that Smithells® Professional.
- Your selected Smithells® Professional owns and manages their own business and clients. Your relationship with your Smithells® Professional is one based on mutual respect, honesty, teamwork and trust. Smithells®NZ and First Careers (NZ) Ltd have no direct control over that relationship.
- If you have any questions, concerns or complaints relating to your appointment, please contact the Smithells® Professional in the first instance by email, telephone or fax. For advice and suggestions, click on the FAQs (Frequently Asked Questions) menu button on the Home Page of the Smithells®NZ website and read the FAQ: If I have an issue, a concern or a complaint to do with any career planning with a Smithells® Professional, what do I do?
- In terms of your protection as a consumer, First Careers (NZ) Ltd adheres to the principles outlined in the New Zealand Model Code for Consumer Protection in Electronic Commerce (2000). These include the protections available to you under the Fair Trading Act (1986) and Consumer Guarantees Act (1993).
- The Smithells®NZ website contains material, including the online Smithells® Full or Update Questionnaires, text, images, software, and registered trademarks (including the Smithells®NZ brand) which are subject to copyright and other intellectual property rights licensed to or owned by First Careers (NZ) Limited. Please read our Disclaimer and Copyright Statement (see bottom bar on Home Page) for further information.
- Nothing you do on the Smithells®NZ website or in relation to the website or the online Smithells® Full or Update Questionnaires will transfer any intellectual property rights to you or give you permission to use or distribute any material on or from the website (except with prior, specific authorization in writing from the directors of First Careers (NZ) Ltd).
- You must not infringe the intellectual property rights of First Careers (NZ) Ltd as the owner of the Smithells®NZ website, nor of the licensors, by copying, altering, printing, circulating, changing or engineering change in the material, including the software and the online Smithells® Full or Update Questionnaires.
- First Careers (NZ) Ltd and its suppliers make every reasonable effort to ensure the Smithells®NZ website remains available and accessible to visitors and users. From time to time, the Smithells®NZ website may be inaccessible. This may be beyond First Careers' control, or due to (for example) maintenance, upgrades or improvements.
- First Careers makes every reasonable effort to reply in a timely manner, to all emails from visitors to and users of the Smithells®NZ website. By submitting an email requesting information, advice or support, you consent to First Careers replying to your request by email.
- First Careers does not monitor or edit the information you submit in your emails, or that you provide in your responses to each of the Questionnaires. However, we reserve the right to access or review any client information, and if found to be offensive or unacceptable, to remove that information and to disable access to that information.
- If you have any concerns or complaints about First Careers' online services or products, please email us in the first instance, by clicking on the 'Contact Us' button on the Home Page of this website, and we will respond.
- You accept that our Terms and Conditions are subject to the information in, and your rights under our Privacy Policy (on bottom bar on Home Page).
- First Careers may modify or discontinue the Smithells®NZ website (or any part of it) including the Questionnaires, or any services and products that may from time to time be made available on the website, without notice.
- First Careers reserves the right to revise these Terms and Conditions at any time. By visiting, using or continuing to use the Smithells®NZ website after any revision appears or is displayed on the website, you are deemed to accept all such revisions.
- The laws of New Zealand govern these Terms and Conditions.
- These Terms and Conditions are effective from 1 November 2015.
